
TERMS AND CONDITIONS

1.1. Company shall mean WildEarth Group Ltd (UK Company Number 12957638), with its registered address being ℅ Newton Magnus Ltd, Arrowsmith Court, Station Approach, Broadstone, Dorset, United Kingdom, BH18 8AT.
1.2. Client shall mean the person who accepts the booking by payment, and each person on whose behalf a Tour is booked.
1.3. Tour shall mean the package, safari, accommodation, activities, and travel as advertised, conducted or provided by the Company.
2.1. This booking and subsequent contract between Client and Company shall be deemed to be concluded in the United Kingdom, subject to the terms and conditions reflected herein.
2.2. The booking of a Tour constitutes Client‘s acceptance of these terms as the sole contractual terms that apply as between Company and each person on whose behalf a Tour is booked.
3.1. Reservations cannot be confirmed without a deposit and provisional bookings are not guaranteed prior to the Company receiving the deposit in their accounts.
4.1. A deposit of 40% of the full Tour cost is required to confirm the reservation. This deposit is non-refundable.
4.2. Given the expected demand for the limited number of places available, the Client will be required to provide evidence of payment of the deposit within 48 hours of having been issued with notice of acceptance of a provisional booking.
4.3. Should Client fail to provide proof of the deposit payment within this period, any provisional booking(s) held for Client might be cancelled, and the place(s) offered to the next person on the waiting list.
4.4. The balance of the fare is due 90 days prior to the date of departure.
5.1. Invoice(s) will be issued in United States Dollars (USD) by default. Guests may additionally request pricing in British Pounds (GBP) or South African Rands (ZAR) and will be provided with a quotation based on the ruling exchange rate at the time.
5.2. Payments can be accepted by way of electronic funds transfer (EFT) in United States Dollars (USD), British Pounds (GBP) or South African Rands (ZAR).
5.3. Payments are also accepted by credit card, in United States Dollars (USD), using the Stripe payment processing gateway. Credit card payments attract a surcharge of 3% over and above the listed cost of the Tour.
6.1. Cancellation of bookings by Client must be made in writing and is effective from the date received by Company. The following cancellation fees will be payable by Client:
6.2. Should Client fail to start a Tour, join late, or fail to complete a Tour, no refund shall be made, or liability be accepted, by Company.
6.3. No refunds shall be made by Company for any reason whatsoever, and neither will it accept any claims of any nature, including direct or consequential damages, should any accommodation or services booked on behalf of Client become unavailable, on or prior to the Tour. Should such circumstances arise, Company will attempt to assist Client to recover funds paid on their behalf to third party service providers, but Client hereby indemnifies and holds Company harmless in respect of such or any claim.
6.4. Certain tours do require a minimum number of confirmed bookings. Company advises Client not to book international flights or make other travel arrangements until it is confirmed that the required number of participants has been reached.
6.5. Company reserves the right to cancel any Tour without prior notification. In such event, all monies paid will be refunded in full, which shall constitute the full extent of Company’s liability to Client.
7.1. Each Client is typically entitled to no more than one (1) suitcase, one free piece of checked luggage and one small carry on item. The aircraft that operate between the international airports and most African Safari destinations are typically much smaller than an international aircraft. As a result, they have small luggage holds which means that they impose strict weight and size limitations. Typical luggage specifications are as follows:
` Clients are responsible for checking the luggage restrictions applicable to their flights and for ensuring that they comply therewith.
7.2. Oversized luggage CANNOT be carried on your lap. Safety is our priority and unsecured objects inside the cabin are hazardous.
7.3. Company may refuse to carry luggage more than the aforesaid. All luggage and personal effects are at all times transported at Client’s risk, and Company cannot accept any liability for any loss of, or damage thereto.
8.1. Client acknowledges that Company may appoint a Tour leader who shall oversee the Tour and all matters relating thereto. Client agrees to comply with the Tour leaders’ lawful requirements and instructions.
8.2. Client must always comply strictly with the law, customs and foreign exchange regulations of all countries visited.
8.3. Client agrees to comply with Company requirements with regards to their conduct and shall not in any way constitute a nuisance to any other persons on the Tour. If any Client acts in contravention of the above, Company shall be entitled to terminate Client’s participation on the Tour, without refund of any monies paid, and without liability to Company or its servants or agents. In these circumstances Client shall, at Client’s expense and responsibility, be obliged to make his own way home.
9.1. Client is responsible for ensuring that all necessary documents, passports, visas, health, Covid-19 test certificates or vaccination documents etc, and any other certificates and travel documents are valid and effective.
10.1. Travel, medical and evacuation insurance is compulsory for all Company Tours. Client accepts that it is solely their responsibility to arrange their own insurance. Company reserves the right to demand proof of insurance from Client prior to allowing Client to join a tour party.
11.1. Prior to, and during a Tour, weather, road conditions, mechanical breakdowns, and other incidents beyond the control of Company can influence the performance of a Tour. In the unforeseen event of any of these events occurring, personal expenses, meals, alternative accommodation, and all other resulting costs, including the cost of flying home, are to be borne by Client.
12.1. Company shall have the right to use, without giving any further notice, any photograph or film produced by Company during the Tour, without any payment to, or further permission being sought from Client.
13.1. Client acknowledges being aware of the proposed itinerary and that the Tour
requires a certain level of physical fitness and acknowledges that s/he is medically fit and able to embark upon the Tour.
13.2. Company reserves the right to require Client to provide a certificate of fitness to travel issued by a qualified medical professional. Company further reserves the right to evacuate Client for medical reasons in circumstances where Client’s health and well-being is at risk, as well as in circumstances where adequate medical care cannot be provided to Client on site at Client’s booked accommodation.
13.3. Should medical evacuation be required for any reason, all associated costs will be for the account of Client.
14.1. For the purposes of this clause 14, the definition of Company shall include all directors(s), employees and agents of Company.
14.2. Company shall have no liability whatsoever for any loss, including financial loss, arising from loss of and/or damage to any property of any Client, nor for loss of any nature, including financial loss, arising from the death or injury of any Client, howsoever any such loss, financial loss, damage, injury, or death shall arise, including negligence of any degree on the part of Company.
14.3. Client hereby indemnifies Company against all claims of whatever nature brought against Company by Client, Client’s estate, or family of Client, including dependents, in respect of any personal injury, death, damage, or loss, including financial loss, of any nature howsoever caused, including negligence of any degree.
BY MAKING PAYMENT OF THE DEPOSIT TO COMPANY, I CONFIRM I HAVE READ, FULLY UNDERSTAND AND ACCEPT THE BOOKING TERMS AND CONDITIONS. I FURTHER INDEMNIFY COMPANY, ITS DIRECTORS, EMPLOYEES AND AGENTS AGAINST ANY LIABILITY WHATSOEVER, HOWEVER ARISING, AND UNDERSTAND THAT I UNDERTAKE THE TOUR ENTIRELY AT MY OWN RISK.
